Between Jan. 28 and February 3 of this year, law enforcement in Clark declined 51 detainers while those in Nassau declined 38. In the period of one week, Travis County refused to honor detainers for 12 immigrants from Central America charged with sexual assault.

President Donald Trump ordered the Department of Homeland Security to issue the reports, called the Weekly Declined Detainer Outcome Report, in an executive order in January.

The Declined Detainer Outcome Report is a weekly report that lists the jurisdictions that have declined to honor ICE detainers or requests for notification and includes examples of criminal charges associated with those released aliens. Williamson County declined four recent detainers and Bastrop County declined three.

The report states 3,083 detainers were issued nationwide, with 206 (around 6.7 percent) of those declined. "The Travis County Sheriff's decision to deny ICE detainer requests and release back into our communities criminals charged with heinous crimes - including sexual offenses against children, domestic violence and kidnapping - is risky and should be criminal in itself".

Gov. Greg Abbott has cracked down hard on Travis County Sheriff Sally Hernandez for enacting sanctuary city policies, which limit cooperation with immigration authorities and restrict law enforcement officers' ability to ask about a person's immigration status.

President Donald Trump ordered Homeland Security to compile the list of noncooperative agencies and cases in his January 25 executive order intensifying deportation efforts.

The charges range from homicide and rape to driving violations and probation violations.

The suspects in those jails had convictions for domestic violence, burglary and forgery, among other crimes. The fear is that if community members believed that if they interact with police in any way their information could be sent to ICE for potential deportation, regardless of the seriousness of a potential crime, they will be afraid to cooperate with police even in cases where they are helping to prevent and stop crime. Trump changed those priorities to include undocumented immigrants accused of any crime.

U.S. Immigration and Customs Enforcement (ICE) issues detainers to federal, state, and local law enforcement agencies to provide notice of its intent to assume custody of a removable alien detained in federal, state, or local custody. Some jurisdictions feel that legally, without a warrant from ICE, they can not detain individuals beyond the extent otherwise dictated by criminal law. Hundreds of local police agencies depend on hundreds of millions of dollars in grants from Homeland Security and the Department of Justice.

"This is an effort for us to be transparent with regards to how we conduct our enforcement operations and the public safety from those agencies that don't cooperate with those enforcement efforts", said a senior DHS official in a briefing call with reporters.
