Gorsuch to Face Capitol Heat
A Supreme Court confirmation hearing is a major occasion on Capitol Hill - the last one was in 2010 - but Monday's was overshadowed by a separate event in the Capitol complex.
Gorsuch dismissed the notion that Microsoft had to provide Novell with its intellectual property in order to avoid harming Novell's marking position.
The issue of whether the IDEA requires "some" progress or "significant" progress is one that courts have differed on and the question is now before the Supreme Court in a separate case with a ruling expected later this year.
In a letter dated Monday and sent to members of the Senate Judiciary Committee, Elway writes that Gorsuch "has demonstrated tremendous intelligence, character and fairness" as a federal appeals court judge based in Denver.
Second-ranking Senate Democrat Dick Durbin of IL told Gorsuch, "In case after case, you've either dismissed or rejected the efforts of workers and families to recognize their rights or defend their freedoms".
According to Sisk's account, Gorsuch was teaching a legal ethics class at the school in April 2016 when he turned a general conversation about professional lawyers' work-life balance into a discussion focused specifically on pregnant women.
The nonpartisan watchdog group Fix the Courts has also filed a lawsuit in federal court after the DOJ failed to respond to its Freedom of Information Act request for Gorsuch's records.
Democratic Senator Patrick Leahy said he was anxious that Gorsuch's conservative method of interpreting the Constitution " goes beyond being a philosophy and becomes an agenda" that is anti-abortion, anti-environment and pro-business.
The Republican spending machine is adding dollars on top of dollars - the Judicial Crisis Network, the well-funded outside group doing the lion's share of the pro-Gorsuch advertising, has budgeted another $5.5 million to spend, and one pro-Trump nonprofit, Great America Alliance, on Wednesday unveiled a $3.5 million buy on top of that. The Democrats also took shots at Trump himself, and criticized the fact that Gorsuch appeared on a list of potential Supreme Court nominees vetted by the Federalist Society and Heritage Foundation. Democrats claimed that he's found in favour of corporations over "the little guy" during that time, while Republicans credit him with an intelligent and straightforward approach of interpreting the law as it is, not as anyone would wish it to be.

Sen. Dick Durbin, D-Ill., repeated a comment by White House chief of staff Reince Priebus last month that Gorsuch "represents the type of judge that has the vision of Donald Trump". "I didn't believe it", said Sen.
Throughout the opening day of the hearing, Democrats attempted to draw a distinction between what Sen.
"You're not a politician running for election, judge, as you know", Cornyn said.
With his wife, Louise, sitting just behind him, and dozens of relatives, friends and professional associates nearby, Gorsuch made repeated references to judicial independence and humility. Sometimes the answers we reach aren't ones we would personally prefer.
Judge Neil Gorsuch asks photographers, "Is this what you do all day?"
"The Burwell Court's majority went on to say "(i) n this instance, the context and structure of the (ACA) compel us to depart from what would otherwise be the most natural reading of (a statutory) phrase". Under current rules, Democrats need only 41 votes to filibuster the nomination, but Republicans could eliminate the tactic for blocking Supreme Court appointments by going "nuclear" and changing the rules with a simple majority vote.
Republicans have a 52-48 majority, so at least eight Democrats and independents will have to vote with Republicans.
