Gorsuch to Face Capitol Heat

The important money in politics questions to ask Judge Gorsuch

A Supreme Court confirmation hearing is a major occasion on Capitol Hill - the last one was in 2010 - but Monday's was overshadowed by a separate event in the Capitol complex.

Gorsuch dismissed the notion that Microsoft had to provide Novell with its intellectual property in order to avoid harming Novell's marking position.

The issue of whether the IDEA requires "some" progress or "significant" progress is one that courts have differed on and the question is now before the Supreme Court in a separate case with a ruling expected later this year.

Democrats claimed that he's found in favour of corporations over "the little guy" during that time, while Republicans credit him with an intelligent and straightforward approach of interpreting the law as it is, not as anyone would wish it to be.

"The Burwell Court's majority went on to say "(i) n this instance, the context and structure of the (ACA) compel us to depart from what would otherwise be the most natural reading of (a statutory) phrase". Under current rules, Democrats need only 41 votes to filibuster the nomination, but Republicans could eliminate the tactic for blocking Supreme Court appointments by going "nuclear" and changing the rules with a simple majority vote.

Republicans have a 52-48 majority, so at least eight Democrats and independents will have to vote with Republicans.
