SC notice to Centre, RBI over plea on old currency deposits

Give people with difficulty a chance to deposit demonetised notes SC tells centre

The Chief Justice of India, J S Khehar said, that the government has used its discretion on short notice to permit one category only, even though the law allows the govt to prolong the relief to other categories as well.

The next hearing on the case will be held on April 11.

The pPrime minister's speech gave hope to those in difficulty to deposit demonetised currency by March 31.

The Supreme Court today asked the Centre why it chose not to create a separate category for those who couldn't deposit demonetised notes by December 30, 2016 unlike the NRIs and people who were overseas.

The apex court observed that the ordinance was promulgated on the very last day (December 30) without any prior notice to the public.

The Centre has been asked to respond within two weeks.

The apex court had on March 6 sought the responses of the Centre and the Reserve Bank of India as to why demonetised notes were not accepted till March 31 as was promised.

The SC sought to know if the Centre intends giving people another chance to deposit demonetised currency under the ordinance to people with genuine difficulty.

The decision is based on the Supreme Court, which firmly pointed out today that when Prime Minister Narendra Modi made the shock announcement of demonetisation, he said that people would have till the end of March to give the cancelled notes to banks.

The petitioner has referred to the Specified Bank Notes Cessation of Liabilities Ordinance and said it had breached the assurance. The petitioners were also asked to show the documents whether they had gone to banks to deposit the old currency notes or not.

However, there was confusion about the window with many assuming that it was open for anyone who had failed to deposit the money by the December 30 deadline.
