Flynn previously refused to turn over the documents to Senate Intelligence Committee prompting the subpoena in the first place.

"General Flynn's attorneys have not yet indicated their intentions regarding the Senate Intelligence Committee's subpoena", Burr's spokesperson said.

The Senate committee is one of several on Capitol Hill investigating possible collusion between Russian Federation and President Donald Trump's 2016 campaign.

Former acting attorney general Sally Yates, a Barack Obama appointee held over for the start of the new administration but fired by Trump, said under oath this month that she warned the White House that Flynn had been interviewed by the Federal Bureau of Investigation and that he could potentially be blackmailed by Russians over his misleading claims. Emails, text messages, letters, phone records and information about financial and real estate holdings associated with Russian Federation were among the information requested by the committee.

Flynn's attorney Robert Kelner did not respond to phone messages and emails seeking comment.

Several reports have suggested that Flynn's failure to comply could lead to a charge of contempt of Congress.

The op-ed prompted scrutiny by the Justice Department, and now a full-fledged federal investigation. In 2008, the House voted to hold White House Chief of Staff Josh Bolten and former White House counsel Harriet Miers in contempt over their refusal to cooperate with an investigation into the mass firings of USA attorneys by the administration of George W. Bush.

Flynn is separately being investigated by the Defense Department's inspector general.

As a retired military officer, Flynn is prohibited under the emoluments clause of the Constitution from accepting payment from a foreign government without advance permission from both the secretary of State and the secretary of the Army. Typically, certifications against sitting executive branch officials have been made to the U.S. Attorney for the District of Columbia.
