Republican incumbent David Yancey was elected to the Virginia House of Delegates Thursday after his name was drawn from a bowl in an odd tie breaking measure mandated by an arcane state law. Under Virginia law, the way to resolve a tied election is "by lot", and the State Board of Elections is set to do so on Thursday.

To settle the matter, the Board of Elections planned to break the tie by selecting the victor from a clear glass bowl before Christmas in Richmond.

Still, Simonds said she was not conceding the race but instead will take time to reflect on a run that has brought unprecedented national attention to the state race.

Yancey is a three-term delegate trying to avoid the fate of more than a dozen of his House colleagues swept away on an Election Day tidal wave that obliterated the two-thirds Republican majority.

Yancey, who did not attend the random drawing ceremony, said in a statement that he looked forward to getting back to work. However, today's vote was even more significant because it will also determine the speaker of the house and committee assignments. The election has been widely seen as a potential harbinger of the 2018 midterm congressional elections. Democrat Ralph Northam also won the governor's race.

Another House of Delegates seat, District 28, is still in dispute: in the Fredericksburg area, a group of Democratic voters has asked a federal judge for a new election after a mix-up over district boundaries caused some voters to be assigned to the wrong districts.

The ballot wasn't counted during the recount and was identified after a Republican election official raised concerns the following day.

The balance of power in the House could shift again because a lawsuit is pending over the results of another House race in Northern Virginia. A hearing regarding the request for a new election is scheduled for Friday in Alexandria.
