The challenge has been brought by Andrew Miller, an ex-Roger Stone aide who argues that Mueller's appointment was unconstitutional because it was made by Deputy Attorney General Rod Rosenstein - who had oversight over the federal Russian Federation investigation because Sessions was recused - rather than by the attorney general. Never having gone through a Senate hearing, he is now under scrutiny for his background as a bare-knuckled Republican activist and director of a now-defunct invention-promotion company that the Federal Trade Commission said "bilked thousands of consumers out of millions of dollars".
Those included an op-ed article in which he said Mueller would be straying outside his mandate if he investigated Trump family finances and a radio interview in which he maintained there was no evidence of collusion between the Kremlin and the Trump campaign.
During the Thursday conference call, House Democrats said they would attempt to include legislation protecting Mueller's investigation into an appropriations bill that Congress is due to consider later this year.
Despite Whitaker's appearance at several White House meetings, Trump said he does not know him very well but that he is "very, very highly thought of".
The first was, we have heard leading Democrats, and now many people around the country today, saying Whitaker has to recuse himself because he has clearly expressed he's already made up his mind about Mueller's investigation.
Whitaker was virtually unknown to Sessions before becoming his chief of staff.

Schumer said Trump's appointment of Whitaker without Senate confirmation "ignored the statutory line of succession and potentially violated the Appointments Clause of the Constitution, which requires all principal officers of the government to be nominated by the president by and with the advice and consent of the Senate".
Whitaker has his supporters too, including a USA senator from Iowa, Joni Ernst. "However, we do not believe increased Democratic oversight will prevent Whitaker or his successor from restricting Mueller's work". Whitaker, he said, has not sought his advice.
"I think it's paramount to the solidity of American institutional existence, democracy itself".
"The president has said repeatedly he's not going to dismiss the Mueller investigation", McConnell told reporters at Kentucky's Capitol.
Republican Sen. Lindsey Graham (R-SC) says there's no need for concern.
